Is the Bluetooth Tx Power Level changing in BLE Firmware?

Hello,

We need to use the RSSI value of BLE signals sent from the Smartphone to estimate the distance between the Smartphone and the Reader Device. Unfortunately in some cases with the same environment we got higher value in a higher distance. We are actually using Samsung 8. Besides the influence of fading and interferance, our assumption is that the controller in the BLE chipset integrated BCM4361 is changing the Tx Power Level.

Is the Controller of the BLE chipset indeed changing this value? What are the conditions?
